Sinixt Nation Serves Cease and Desist Order to Her Majesty in Right of Canada and British Columbia Timber Sales
A permanent camp has been established to defend Sinixt culture and lands. The right to defend human rights is a lawful one. Permanent buildings are being built on slhu7kin to assist Sinixt in the pursuit of cultural, social, and economic, and religious developments. eg. berry picking, medicine gathering, hunting, trapping, vision quests, spiritual development, etc.
The camp will be hosting work parties throughout the summer to help with the building of the first of a few permanent Sinixt Cultural-Use buildings along the ridge.

To: HER MAJESTY THE QUEEN IN RIGHT OF CANADA (Her Majesty)

June 10th 2013,
RE: Cease and Desist Order to Her Majesty from engaging in acts and omissions which inflict conditions of life that deprive Sinixt from pursuing religious and cultural development on slhu7kin (Perry Ridge).
This CEASE AND DESIST ORDER is to inform you of your persistent actions, including but not limited to;
1. treating free human beings (skelxw) in association with Sinixt Nation inhumanely by continuing to determine the political status of skelxw in association with Sinixt Nation as EXTINCT, and
2. depriving skelxw in association with Sinixt Nation to the fundamental freedom of equality as is shown with other First Nations in regards to consultations and Her Majesty's conduct in Sinixt-territory by discriminating against members of our tribal group, and
3. inflicting conditions of life which deprive the skelxw in free-association with Sinixt Nation from pursuing their social, religious and cultural development on or near slhu7kin, and
4. issuing and/or accepting contracts for developments on or near slhu7kin, as slhu7kin is an essential cultural use area of skelxw in association with Sinixt Nation and is essential to the said skelxw to continue to pursue their own means of subsistence, and
5. conducting industrial development on slhu7kin (Perry Ridge) as previous developments have already caused mental harm to skelxw in association with Sinixt Nation.
The said persistent actions have become unbearable. You are ORDERED TO STOP such activities immediately as they are being done in violation of conventional international law enforced under the ROME STATUTE to which Her Majesty is contracted to and to which Her Majesty holds legally binding obligations to customary international law.
skelxw in free-association with Sinixt Nation have the right to remain free from these activities as they constitute crimes against humanity and/or genocide according to conventional and customary international law, and will pursue any legal remedies available to our group against you if these activities continue.
These remedies include but are not limited to: contacting the International Criminal Court to file criminal charges of genocide and/or crimes against humanity against Her Majesty and BCTS, filing domestic criminal charges of genocide and/or crimes against humanity against Her Majesty and BCTS and/or suing Her Majesty and BCTS civilly for damages we have incurred as a result of your actions.
Again, you must IMMEDIATELY STOP issuing contracts for developments on slhu7kin (Perry Ridge) and send us written confirmation that you will stop such activities. You risk incurring some very severe legal consequences if you fail to comply with this demand.
This letter acts as your final warning to discontinue this unwanted conduct before the undersigned pursue legal actions against you. At this time, we are not contacting the authorities or filing civil suit against you, as we hope we can resolve this matter without authoritative involvement. We are not under any circumstances, however, waiving any legal rights we have presently, or future legal remedies against you by sending you this letter. This order acts as ONE FINAL CHANCE for you to cease your illegal activities before the undersigned exercise their rights.
To ensure compliance with this letter, and to halt any legal action the undersigned may take against you, we require you to fill in and sign the attached form and mail it back to us within 14 days of your receipt of this letter. Failure to do so will act as evidence of your infringement upon our legal rights, and we will immediately seek legal avenues to remedy the situation.
Please considering and take notice of the following:
According to Part I, Article 1, Section 3 of the United Nations International Covenant on Economic, Social, and Cultural Rights (UN-ICESCR), all Parties contracted to the said convention, including but not limited to Her Majesty, “shall promote the realization of the right to self-determination, and shall respect that right, in conformity with the provisions of the Charter of the United Nations.” and
The UN-ICESCR reads under Part I Article 1 Section 1 “All peoples have the right of self-determination. By virtue of that right they freely determine their political status and freely pursue their economic, social, and cultural development.” and
And according to the UN-ICESR under Part I Article 1 Section 2 “All peoples may, for their own ends, freely dispose of their natural wealth and resources without prejudice to any obligations arising out of international economic co-operation, based upon the principle of mutual benefit...,” and
The Canadian Charter of Rights and Freedoms section 5 states that “everyone has the right of freedom of association,” and
skelxw retain the right to self-determine their own political status and continue to act in the capacity as free-human-beings according to Sinixt cultural and religious customs and according to the ideals of the United Nations and conventional international law, and
skelxw in association with Sinixt Nation do not freely dispose of their inherent natural wealth and resources according to conventional international law, and
skelxw living on slhu7kin are protecting their intrinsic human-rights and are continuing to occupy and use the land surrounding slhu7kin in the pursuit of their cultural and religious rights and customs, and
The Royal Canadian Mounted Police (RCMP) have a duty to enforce international law,
skelxw are entitled to but not necessarily obligated to the international human-rights guaranteed to them according to conventional international law to which Her Majesty is legally obligated to including but not limited to;
(i) United Nations Convention for the Prevention and Punishment of the Crime of Genocide
(ii)United Nations Covenant on Social, Economic and Cultural Rights, and
(iii)United Nations Covenant on Civil and Political Rights, and
skelxw in association with Sinixt Nation have never ceded, surrendered, sold, or abandoned Sinixt-territory.
